Information for foreigners

ICT MOBILITY

The procedures of Internal Company Transfer and short-term and long-term mobility concern foreigners whose aim is to perform work as a manager, specialist or employee completing an internship in the so-called receiving unit.

A foreigner is seconded temporarily to the receiving unit by the parent employer having a registered office outside the territory of the member states of the  European Union, the European Free Trade Association  (EFTA), the parties to the agreement on the European Economic Area  or the Swiss Confederation. The receiving unit must remain in capital and organizational relations with  this entity– in particular, it must be an branch or a representative  of the parent employer or belong to the same  group of entrepreneurs as the  parent employer.

 Internal Company Transfer:

An application for granting a permit for a temporary residence to a foreigner  in order to perform work within the framework of an Internal Company Transfer  is submitted by a person acting on behalf and for the benefit of  the receiving unit with the registered office  on the territory of the RP to the province governor competent for the registered office of the receiving unit.  

A foreigner must stay outside the territory of the EU member states. After issuing a permit to a foreigner, they will be able to obtain a visa for the purpose of its implementation; and they ought to submit an application for issuing a residence card after arriving in Poland. A foreigner’s Residence Card shall have the annotation “ICT,” and it makes it possible to make use of mobility  in the EU member states applying directive 2014/66/EU (detailed information on the rules of using the aforementioned directive may be provided by competent migration authorities in these countries).

 

 Short-term Mobility:

It enables the use of mobility (up to 90 days in any period  of 180 days) on the territory of Poland by a foreigner holding a residence document with the "ICT" annotation issued in another country of the European Union within a period not exceeding the validity period of this permit.  The receiving unit from the so-called first member state (that is the one in which a document with the "ICT" annotation has been issued) forwards the notification to the Head of the Office for Foreigners about the intention of using this form of mobility.

 

 Long-term mobility

It enables the use of mobility (for a period exceeding 90 days) on the territory of Poland by a foreigner holding a residence document with the "ICT" annotation issued in another country of the European Union within a period not exceeding the validity period of this permit. An application is submitted by the receiving unit to the  province governor  competent for its registered office on the territory of the Republic of Poland. In the case of submitting an application for the first time, a foreigner may stay both on the territory of the Republic of Poland and outside it.
