Seasonal work
Who can submitt an application?
An application for granting a temporary permit due to seasonal work is submitted by a foreigner for whose stay in Poland aims at performing work that is mentioned in art. 88 para. 2 of the Employment Promotion and Labour Market Institutions Act of 20 April 2004 (seasonal work) at an entity entrusting performing work so far or at another entity entrusting performing work.
This permit is granted for the period of a seasonal work permit or the extension of a seasonal work permit possessed by a foreigner, no longer than 9 months from the first day of entry for the purpose of seasonal work, occurring within a given calendar year. This permit can be also granted, if the circumstances of applying for this permit do not justify a foreigner’s stay on the territory of the Republic of Poland for a period longer than 3 months. A Foreigner receives a Residence Card with the annotation “seasonal work” on its basis.
Note! This permit does not grant a foreigner the right to access the Polish labour market independently. Taking up employment is possible under the condition that a foreigner possesses a seasonal work permit or an extension of a seasonal work permit.
Important:
- In order to apply for a temporary residence permit due to seasonal work, a foreigner ought to enter Poland on the basis of a visa issued for seasonal work or within the framework of visa-free traffic in connection with an application for a seasonal work permit entered into an application register, which is kept by the competent staroste.
- A seasonal work permit is issued by the staroste with jurisdiction over the registered office or place of residence of the entity entrusting work to a foreigner.
