Who can submitt an application?
The application for a temporary residence permit due to other circumstances is submitted by persons intending to:
- take up or continue education in Poland;
- take up or continue vocational training;
- seek employment on the territory of the Republic of Poland as the graduates of a Polish university;
This category also includes temporary residence permits granted to:
- priests, the members of an order or persons performing religious duties in a church or a religious association whose status is regulated by an international agreement, the provisions of law applicable on the territory of the Republic of Poland or who operate on the basis of an entry into the register of churches and other religious associations, and if their stay on the territory of the Republic of Poland is related to the function fulfilled or preparation for fulfilling it;
- for minors born on the territory of the Republic of Poland and staying without care on this territory;
- due to circumstances requiring a short stay;
- in other circumstances justifying a stay on the territory of the Republic of Poland for a period exceeding 3 months.
A temporary residence permit in connection with circumstances requiring a short stay may be granted to a Foreigner who resides in Poland, if:
- they are obliged to appear in person before a Polish public authority, or
- the presence of a foreigner on the territory of the Republic of Poland is required by their exceptional personal situation, or
- the presence of a foreigner on the territory of the Republic of Poland is required by the interest of the Republic of Poland.
A permit is granted for the period necessary to achieve the purpose of a foreigner’s stay, however, no longer than 6 months. This permit may also be granted when the circumstances of applying for this permit do not justify a foreigner’s stay on the territory of the Republic of Poland for a period longer than 3 months.
A temporary residence permit for a graduate of a Polish university seeking employment is granted once, immediately after completing studies for the period of 1 year.
A temporary residence permit for the purpose of studying may be granted for the period of education, exceeding 3 months, but no longer than 1 year with the possibility of applying for another permit.
In other cases, a temporary residence permit due to other circumstances is granted for the period necessary to achieve the purpose of a foreigner’s stay on the territory of Poland exceeding 3 months up to 3 years with the possibility of applying for another permit.
In the case of a foreigner who is a minor, an application for a temporary residence permit is submitted by the parents or by guardians appointed by the court or by one parent or by one guardian appointed by the court.
When submitting an application for granting a temporary residence permit to a foreigner who is a minor who has turned 6 years old at the date of submitting the application, their presence is required. The obligation of being fingerprinted does not apply to foreigners who have not turned 6 years old at the date of submitting the application.
A temporary residence permit due to other circumstances does not grant a foreigner the right to access the Polish labour market. Taking up employment is subject to the general rules provided that a foreigner has a work permit, unless it is not required (e.g. for graduates of full-time studies in Poland, priests performing work in connection with religious functions).
