Right of permanent residence of an EU citizen
What documents do I have to submit?
- an application for the issue of the document certifying the permanent residence right,;
- a travel document or another document confirming your identity and citizenship;
- 5 recent colour photographs, undamaged, size 45x35 mm, made in the last six months on a plain white background, with good focus, clearly showing the eyes and face from the top of the head to the top of the shoulders; the face should occupy 70-80% of the photograph; the photograph should show the person looking straight ahead with their eyes open, not covered by hair, with a natural facial expression and mouth closed
Aliens with congenital or acquired vision defects may attach a photograph showing them wearing glasses with dark lenses.
The photographs should be permanently attached to the application by sticking it in a relevant place,
Aliens wearing a headdress in accordance with the principles of their religion may attach a photograph in the headdress, as long as the face is fully visible. - documents confirming a 5-year of continuous residence on the territory of the Republic of Poland.
Before the end of the 5-year period of stay on the territory of the Republic of Poland, the right of permanent residence is acquired by:
1. Discontinuance of work or other gainful activity on one's own behalf and on a self-employed basis and reaching the pensionable age specified by the Polish regulations concerning pension insurance or discontinuance of work or other gainful activity on one's own behalf and on a self-employed basis in order to retire early.
Apart from the required documents, one should also attach:
- documents confirming performance of work or other gainful activity on one's own behalf and on a self-employed basis on the territory of the Republic of Poland or in another Member State for the period of 12 months before the retirement or early retirement,
- documents confirming a continuous stay in Poland for a period longer than 3 years,
2. Discontinuance of work or other gainful activity on one's own behalf and on a self-employed basis on the territory of the Republic of Poland due to permanent inability to work.
Apart from the required documents, one should also attach:
- documents confirming discontinuance of work or other gainful activity on one's own behalf and on a self-employed basis on the territory of the Republic of Poland or another Member State,
- documents confirming discontinuance of work due to permanent inability to work,
- documents confirming a continuous stay on the territory of the Republic of Poland for a period longer than 2 years,
3. Discontinuance of work or other gainful activity on one's own behalf and on a self-employed basis on the territory of the Republic of Poland due to permanent inability to work or an occupational disease.
Apart from the required documents, one should also attach:
- documents confirming discontinuance of work or other gainful activity on one's own behalf and on a self-employed basis on the territory of the Republic of Poland or another Member State,
- documents confirming permanent inability to work due to an accident at work or an occupational disease,
4. Marriage to a Polish citizen who has discontinued work or other gainful activity on one's own behalf and on a self-employed basis and reached the pensionable age specified by the Polish regulations concerning pension insurance or discontinued work or other gainful activity on one's own behalf and on a self-employed basis in order to retire early.
Apart from the required documents, one should also attach:
- an up-to-date copy of a marriage certificate,
- a copy of the spouse's identity document,
- documents confirming that you have reached the retirement age specified by the Polish regulations concerning pension insurance,
- documents confirming discontinuance of work or other gainful activity on one's own behalf and on a self-employed basis on the territory of the Republic of Poland.
5. Marriage to a Polish citizen of a person who has discontinued work or other gainful activity on one's own behalf and on a self-employed basis due to permanent inability to work.
Apart from the required documents, one should also attach:
- an up-to-date copy of a marriage certificate,
- a copy of the spouse's identity document,
- documents confirming discontinuance of work or other gainful activity on one's own behalf and on a self-employed basis on the territory of the Republic of Poland or another Member State,
- documents confirming permanent inability to work.
6. 3-year continuous stay and performance of work or other gainful activity on one's own behalf and on a self-employed basis on the territory of the Republic of Poland by a person who performs work or other gainful activity on one's own behalf and on a self-employed basis on the territory of another Member State, still residing on the territory of the Republic of Poland, where she/he returns at lease once a week.
Apart from the required documents, one should also attach:
- documents confirming a continuous stay in Poland for 3 years,
- documents confirming discontinuance of work or other gainful activity on one's own behalf and on a self-employed basis on the territory of the Republic of Poland for 3 years,
- documents confirming discontinuance of work or other gainful activity on one's own behalf and on a self-employed basis in another Member State,
- documents confirming one's residence on territory of the Republic Poland,
- documents confirming one's return to another Member State at least once a week.
